This agreement may be concluded in English or the language in which it is drafted by Pigmenta and appears to you online, as applicable. If you are residingoutside of the USA then this agreement shall not affect your statutory rights under the local laws in your country.

Before YOU are authorized to visit or access materials (referred to herein as “service” or “website”) provided at the Pigmenta website (https://www.pigmentausa.com), YOU are required to read and accept the following Terms and Conditions of Access, Use and Membership (the “Agreement”). Please take care to carefully read and understand each and every provision contained in this agreement prior to determining whether YOU agree to proceed into this website. This Agreement is made and entered into by and between YOU, a person desiring to access and make personal use of the materials appearing in the website (“YOU”) and Pigmenta, the owner and operator of this website (https://www.pigmentausa.com). For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by YOU and Pigmenta and by further accessing or otherwise taking advantage of the services and materials provided by Pigmenta, YOU agree to be bound by all the terms and conditions set forth herein. Subject to the provisions set forth in this Agreement, Pigmenta grants YOU a non-exclusive, but wholly revocable license, to access the website. This Agreement is subject to change by Pigmenta without notice and at any time.

Restrictions on use of Contents and Copyright

All contents, including images, text, graphics, videos and audio contents (the “contents”) contained in Pigmenta is protected under the laws of copyright, owned or under license to Pigmenta or its designees and represents proprietary and valuable intellectual property. YOU cannot, under any circumstances, access, view, download, receive and make use of said contents except as specifically and in writing authorized by Pigmenta. Upon becoming a subscriber member of the website, the Pigmenta grants YOU a limited, non-exclusive, nontransferable, revocable license to access and view the graphics files, audio files, video files, text, hyperlinks, interlinks, search engines and other software associated with authorized subscriber member use of the contents. YOU agree that YOU shall at no time access, view, download, receive or otherwise use, or cause or enable others to access, view, download, receive or otherwise use materials, directly or indirectly in places which the Pigmenta does not authorize such access, viewing, downloading, receipt or other use YOU hereby acknowledge and agree that no materials from any parts of Pigmenta are authorized and no materials are intended, by the Pigmenta to be accessed, viewed, downloaded or used by, or transmitted, broadcast or otherwise disseminated to any person or entity located in any and all areas designated as Prohibited Access Areas below. YOU agree that any and all unauthorized access, viewing, downloading, receipt, duplication or other use of materials from Pigmenta, in which YOU are directly or indirectly involved, including, but not limited to accessing, viewing, downloading, receiving or other use of materials in Prohibited Access Areas in any manner shall constitute intentional infringement(s) of Pigmenta and potentially other’s intellectual property rights and other rights in such materials and shall further constitute a violation of Pigmenta’s trademark and other rights, including, but not limited to, rights of privacy.

Trademarks

Pigmenta is a registered trademark. The names of actual companies and products mentioned herein may be the trademarks of their respective owners. The example companies, organizations, products, people and events depicted herein are fictitious. No association with any real company, organization, product, person, or event is intended or should be inferred. Nothing on this site grants the right to use any trademark displayed on this site, except the expressed written permission of the trademark owner.

Logo Policy

Pigmenta logos are the property of Pigmenta and cannot be changed or modified for any reason. For more information on customized logos, for use in conjunction with Pigmenta business partnerships and enterprises, contact our legal department at pigmenta@usa.net.

Local Laws

All text, images, graphics, messages and communications, found in Pigmenta (collectively referred to herein as “contents”) are only authorized for distribution exclusively to persons over the age of majority (eighteen (18) years of age in most jurisdictions, but 21 years of age in AL, MS, NE, NY all other jurisdictions where 21 is the age of majority) who access the website in locations where such contents does not infringe upon or violate any local standard of decency or any federal, state or local law or regulation of the United States or any other country. No person who is under the age of eighteen (18) years (or 21, where appropriate) may directly or indirectly view, download or possess any of the contents of Pigmenta. YOU are responsible for knowing and understanding the standard of decency and other laws ad regulations in place in YOUR community concerning adult-oriented contents and Pigmenta in no way represents or warrants that the contents contained in Pigmenta is compliant with YOUR local laws.

Parental Advisory

The Parental Advisory is a notice to consumers that lyrics or recordings identified by this logo may contain strong language or depiction of violence, sex or substance abuse. Parental discretion is advised. American Charisma, New Sound Perspective and Pigmenta reserves the right to restrict sales or other forms of distribution to children of product carrying the Parental Advisory.

Sexual or other “Disturbing” Contents

This website may contains graphic depiction of nudity and sexual conduct. YOU hereby acknowledge and agree that contents contained in movies, audio files, photos/pictures, illustrations or lyrics reflects explicit depiction of nudity and heterosexual, bisexual, homosexual and transsexual situations of a sexual nature, that YOU are familiar with materials of this kind and that YOU are not offended by such materials. If YOU are, or may be, so offended, YOU are strongly advised to refrain from accessing the website. Also, that movies, audio files, photos/pictures, illustrations or lyrics may contain strong language or depiction of violence (extreme violence), substance abuse or racial discrimination.

Prohibited Access Areas

There are companies and individuals currently claiming to be affiliated with Pigmenta or the Pigmenta (Pigmenta, Inc.) and are not authorized to do so. The products and services offered by these parties may not be genuine Pigmenta certified business practices and don’t carry the quality-warranty from the Pigmenta. Dealing with those parties may be risky and may be a criminal violation. We provide certified and trained staff, up-to-date business practices and genuine Pigmenta products and services worldwide. To protect yourself from fraud, please report suspicious trading behaviors by emailing us at pigmenta@usa.net. An Pigmenta representative will check your case and let you know whether our company authorizes it.

YOU shall at no time access, view, download, receive or otherwise use, or cause or enable any other person or entity to access, view, download, receive or make use of any portion of said contents, directly or indirectly in places where Pigmenta does not authorize such access, viewing, downloading, receipt or other use, including but not limited to “Restricted Areas.” As used herein, “Restricted Areas” means the following geographical areas: Any nation, state or province or portion thereof where the access, viewing, downloading or any other use of the contents would, or could reasonably, be a violation of any civil or criminal law, governmental regulation or court decision.
